
Actress Maribel Guardia has filed a legal complaint against her daughter-in-law Imelda Garza Tuñón in Mexico with the aim of protecting her grandson, José Julián. Guardia has taken care of the child during his mother's absence, and upon Imelda's return, she was allegedly under the influence of substances and alcohol. Following a positive drug test for Garza Tuñón, José Julián was removed from her custody and placed under the protection of the capital's Prosecutor's Office.
Imelda Garza Tuñón's legal situation could result in the loss of custody of her son if the accusations are confirmed. According to Article 200 of the Penal Code of Mexico City, in cases of proven domestic violence, parental rights can be revoked. In such cases, the custody decision would rest with the judicial authorities.
According to information provided by journalist Carlos Jiménez, Maribel Guardia has accused Imelda of child abandonment and of frequently returning home in an impaired state after night outings, neglecting her responsibilities toward the 7-year-old child. Additionally, journalist Carlo Uriel reported that the complaint includes accusations of child abuse. Both women appeared at the General Prosecutor's Office of Mexico City, where the minor underwent a psychological assessment to evaluate his situation.
